RULES OF USE: OLD BALDY CLUB

(Including amendments through January, 2016)

ARTICLE I – DEFINITIONS

As used in these Rules, the following terms, unless a different meaning or intent is shown of the context shall indicate or require otherwise, shall have the following meaning, respectively:

  1. The Club – The name of this club shall be “Old Baldy Club”. The Club is situated one mile east of Saratoga, Wyoming.
  2. Club – the Old Baldy Club, a Wyoming nonprofit corporation.
  3. Board – the Board of Directors of the Old Baldy Club
  4. Member – A person receiving the rights and privileges of the Club under one of the following classes of membership.
  5. Guest – A person who through the sponsorship of a Club Member may use the Club facilities.

For the purpose of these Rules, unless the context shall indicate or require otherwise, words of the singular shall be determined and construed to in correlative words of the plural and vice versa.

ARTICLE II – DIRECTORS

  1. The Club shall be administered by the Manager of the Club.
  2. The Management of the Club will be directed by the Board of Old Baldy Club who are Directors of Old Baldy Corporation, having been elected by the Shareholders.

ARTICLE III – MEMBERSHIP

The Board has the right to limit the number and classifications of membership. Memberships shall be limited to 50 for those who have a primary residence within a 50-mile radius of the Club.

Legacy Members: Class A Members who have transferred their Class A stock to a Class A Permitted Transferee as that term is defined in the Amended and Restated Articles of Incorporation of Old Baldy Corporation are, so long as said transferee remains a Regular Member in good standing in the Club, entitled to full rights and privileges agreeing to pay all charges payable by Regular Members.
  6. Children of Members: Children of Members shall be entitled to all privileges enjoyed by such Member up to the age of 24. Thereafter, children shall be considered guests and may use the facilities in accordance with the Club’s guest policies.
  7. Honorary and Lifetime Members: Honorary and Lifetime Members may be elected by the Board.
  8. Disciplinary Action: In the event of conduct unbecoming to a Member, violation of the Rules of Use, conduct detrimental to the interest or welfare of the Club, its order or peace, or failure to pay any and all sums or amounts due the Club on or before sixty days after billing, the Board shall take such disciplinary action as seems warranted. Action taken by the Board shall be final and may result in expulsion of such Member.

ARTICLE IV – DUES, ASSESSMENTS, AND CHARGES

  1. The Board shall fix the dues and assessments annually. All dues and assessments are payable no later than February 15.
  2. All charges for goods and services are billed monthly.
  3. Any and all sums or amounts due the Club shall be due and payable on or before thirty days after billing. Accounts remaining unpaid after thirty days from billing shall be considered in default and subject to penalty for late payment at a rate of 5 % per month.
  4. A Member whose account is in default for 90 days or more is suspended from exercising further privileges with the Club until the account including interest accrued and penalties for late payment is paid in full.

ARTICLE V – RESERVATION POLICY

Members are required to adhere to the following reservation policy in order to receive preferential choice of reservations:

  1. An advance deposit equal to twenty-five percent of the total estimated room charges will be required on all reservations.
  2. Cancellations: A full refund of the deposit is allowed for any reservation canceled fifteen days prior to arrival date, but no refund for less than fifteen days notice. In the absence of extenuating circumstances confirmed by the General Manager, a guest leaving before the end of his/her reservation period will be charged at 50% of the full daily rate for the remainder of the reserved period.

ARTICLE VI – GUESTS

Members may cause guest privileges to be extended to their friends subject to the following:

  1. Limitations on guest visitation to the Club:
  2. The Member must assume full financial responsibility for the guests’ debts or obligations incurred including fees, purchases, accommodations or other compensable services furnished by the Club to said guest.
  3. No Member may extend reciprocal club privileges to any member of another club.
  4. Guests may not extend guest privileges to others.
  5. The Board has the right to suspend the issuance of guest privileges during any period, on either a category basis applying to all guests or an ad hoc basis applying only to one or more individually identified guests.
  6. A former Member who has resigned from the Club shall not be extended guest privileges for a period of two years accompanied or five years unaccompanied by a Member.

ARTICLE VII – GOLF

  1. There will be no charge for Member’s use of the golf course. Green fees for guests will be charged in an amount to be fixed from time to time by the Board.
  2. All players must use a golf cart except when excused by the Head Golf Professional.
  3. The Rules of Golf as defined by the USGA are applicable to play at the Club with Club modifications.
  4. The Head Golf Professional may, at his discretion, allow members to walk and carry their own bag after 1:30 p.m.
  5. Each player must play out of his own golf bag.

ARTICLE VIII – HUNTING

No hunting is permitted on the Club grounds.

ARTICLE IX – FISHING

A very thorough streams management program including a catch and release program has been undertaken at the Club, and to help build unsurpassed trout fishing the following rules will be strictly enforced:

  1. Guests staying at the Club will be charged a fee for fishing Club waters, i.e., the lakes on Club property, the Trout Run and the fishing stations along the Platte River.
  2. Only wet or dry flies may be used when fishing.
  3. All fishermen must comply with applicable Wyoming Game and Fish statutes when fishing privately stocked waters. THIS IS A STATE LAW.
  4. Creel limits will be the same as those specified in the Wyoming Fishing Orders, unless otherwise posted at a particular fishing area. Catch and release is the recommended practice.
  5. Cancellations: Any reservation for float trips and/or guided fishing trips which are cancelled less than 10 days prior to the reservation date will be subject to a 25% cancellation fee. Reservations cancelled with less than 72 hours notice will be subject to a 100% cancellation fee.

ARTICLE X – STANDARD OF ATTIRE

Clubhouse: General Policy

  • During the daytime, dress is casual in the Clubhouse
  • No short shorts, short skirts, abbreviated halter tops, tank or tube tops, swim wear or short tennis dresses allowed in the Clubhouse at any time.

At all times in the Antelope Grill and Trout Lounge

Gentlemen must wear a collared shirt. Denim in good taste*, golf/dress slacks and shorts are permitted. Capri pants are considered slacks. Workout/gym clothes and tee shirts are not permitted. Gentlemen are not permitted to wear hats while seated in the Clubhouse.

  • At all times in the Wyoming Room and Fireplace Lounge
  • If open before 6 p.m., dress is the same as the Antelope Grill
  • After 6 p.m., gentlemen must wear jackets and ties, ascots, or bolo ties. Ladies should wear attire that consists of dresses or tailored pantsuits.
  • We will strictly monitor and enforce dress code compliance. Please take a moment to study the policy, and ensure that your family and guests comply prior to arriving at the Club.

Please note that at no time will denim or cargo pants be allowed on the golf course, putting green, driving range, practice areas, or tennis courts.

When in doubt about the Dress Code for Member Events, just check your Screecher or enquire with the Receptionist or Administrative Offices.

*Definition of Denim, "in good taste":

Denim must be "tasteful" and "in good repair" as follows:

  1. No holes, rips, tears, tatters or frays.
  2. No acid washed denim.
  3. No hand written messages, pictures or inappropriate messages.
  4. No visible undergarments. No midriff.
  5. No baggy or sagging denim or slacks.
  6. No denim shorts of any kind.

Acceptable denim: Denim worn as slacks. Denim in good repair and Denim skirts are tasteful.

ARTICLE XI – SMOKING

  1. No smoking in the clubhouse, lodge, suites, cottages, fitness center or on the cookout grounds.
  2. There is a standard charge of $250.00 for breaking the rule prohibiting smoking.

ARTICLE XII – CELL PHONES

The use of Cell Phones is prohibited on the golf course and in the public areas of the clubhouse.

ARTICLE XIII – PETS

  3. Pets in the Club’s Guest Rooms: With the prior consent of the General Manager requested and granted before occupying the room, no more than two pets may be kept in a guest room. The General Manager shall have sole discretion to determine whether pet(s) may be kept in the room. In the case of cats, the litter box must remain on the porch.

ARTICLE XIV – CLUB EMPLOYEES, PROPERTY AND EQUIPMENT

  1. Gratuities: The Club’s salary scale is designed to insure quality service to all members. Therefore, the giving of gratuities to employees is a choice of the member or guest.
  2. Members may not request the services of on-duty Club employees for personal purposes, including childcare.
  3. Members or guests may not reprimand or discipline any employee of the Club. Any inattention to duty or lack of courtesy by a Club employee is to be promptly reported to the attention of the department head and or the General Manager.
  4. The cost of repairing or replacing Club property broken or damaged by members, their families, guests or child care providers will be charged to the member.
  5. Members may not borrow Club property or equipment without approval of the General Manager or the Board.
  6. No skate boards, bicycles or scooters are allowed on pedestrian areas around the clubhouse, suites and cottages.
